CHOOSING A CRIMINAL DEFENSE LAWYER

The legal profession places no restrictions on the types of cases a lawyer can take.
Once a lawyer passes the bar examination, he can represent a client in a case even if he has no expertise in that field of law. Many lawyers who take on criminal cases simply don’t know enough about the law, the criminal justice system, the prosecutors, and criminal defense strategy and tactics, to get you the best possible result on your case.
The first rule. Don’t hire a lawyer who handles divorces, real estate, wills, auto accidents, and also criminal defense. An experienced, skilled criminal defense specialist has spent an entire career learning how to deal successfully with police, prosecutors, probation officers and judges. He will have strong relationships with key people throughout the system, as well as the best investigators and expert witnesses. Perhaps most important, he can avoid crippling mistakes by knowing what not to do.
There are two kinds of criminal cases that require even more specific expertise. If you are being investigated by Federal authorities or have been charged with a Federal offense, make sure that the lawyer you hire has extensive Federal criminal defense experience. The Federal rules of procedure, rules of evidence and sentencing procedure are dramatically different from those in state court. The right moves in a state criminal case, can be the exact wrong moves to make in Federal court.
The other highly specialized area is sex crime defense. Because this is such an emotional, politically volatile area, the legislature has enacted special rules that make it easier for prosecutors to obtain convictions. There are ways to overcome these advantages that have been given to the prosecutor. A skilled, experienced sex crimes lawyer will know them.
Keep in mind that you may only have one chance to hire the right lawyer. Some mistakes by an unskilled lawyer can’t be corrected, even if you replace him with a highly skilled criminal defense specialist.
It is important to hire a criminal defense lawyer as soon as you know that you are suspected of committing a crime.
